Unfiled & back tax returns

Years behind is more common than you'd think, and it's almost never too late. Getting current is also the gate every other option has to pass through.

The longer returns go unfiled, the heavier the whole thing feels — and the more people avoid opening the envelopes, which makes it heavier still. Here is the part that usually surprises people: filing late, even years late, generally puts you in a much better position than staying unfiled. Nearly every resolution option — a payment plan, a settlement, hardship status, penalty relief — requires you to be filing-compliant first. Unfiled returns aren't just a problem in themselves; they're the lock on every door out.

If you don't file, the IRS may eventually file for you. That's called a substitute for return, and it's built from the income data third parties reported — with no deductions, no credits, no dependents, and no cost basis on any sale. The resulting balance is very often dramatically higher than what you actually owed. Filing a real return can replace that assessment with the correct number, and reductions from that process can be substantial.

The practical obstacle is usually records, not willingness. Most people who've been behind for years don't have the paperwork. We can pull IRS wage and income transcripts that show what was reported under your name for each year, and reconstruct the rest from bank records, prior returns, and standard methods for the years where documentation is genuinely gone. There's also a strategic question of how many years to file — the IRS's general expectation is a defined recent window rather than everything ever missed — and that's worth getting right before you start mailing returns in.

How we handle it

The sequence we follow.

Find out where you stand

Account and wage-and-income transcripts show which years are missing and what was reported to the IRS for each.

Decide the filing window

We determine how many years need to be filed to get you compliant, rather than defaulting to all of them.

Prepare accurate returns

We reconstruct income and deductions from transcripts and available records, and file — replacing any substitute assessment.

Resolve what's left

Once you're current, the balance can be addressed through a plan, penalty relief, or a settlement.

One caution

Refunds have a claim deadline — generally three years — so for the oldest years a refund you were owed may no longer be recoverable, even when the return is filed correctly. That's a reason to start now rather than next year. If your situation involves income that was deliberately unreported, tell us up front so it's handled with the right care from the beginning.

FAQ

Unfiled & back tax returns: common questions

How many years back do I have to file?

Usually fewer than people fear. The IRS generally looks for a defined recent window to consider you compliant rather than every year ever missed, though the specifics depend on your circumstances and any open enforcement. We establish the right window from your transcripts before filing anything.

What if I don't have my records?

That's the normal starting point. IRS wage and income transcripts show what employers, banks, and brokers reported for each year, and the rest can usually be reconstructed from bank statements and prior returns.

Will I go to jail for not filing?

Criminal prosecution for non-filing is rare and generally involves deliberate evasion rather than falling behind. Voluntarily coming forward and filing is viewed very differently than being found. If you have specific concerns about how income was reported, raise them at the first conversation.

The IRS already assessed me. Can filing still help?

Often substantially. A substitute for return omits deductions, credits, dependents, and cost basis, so the assessed balance is frequently much higher than the real one. Filing an accurate return can correct it.
